With the noticeable rise in trademark disputes in the beer industry, self-described beer geek and co-founder of OvalOptions Jason Gladfelter thought that brewers might be interested in the process of mediation over litigation. So, after a year and a half of research, the Denver-based OvalOptions launched the Brewery Mediation Network, a nationwide network that connects craft breweries with local providers of mediation and facilitation.

Trademark disputes—over beer and brewery names and logos—may be the most vocal among craft brewers, but the service also seeks to resolve conflicts between co-workers, owners and investors, and breweries and neighboring businesses.

In an industry where collaboration and partnerships are valued, mediation, which is confidential and voluntary, can be a more appealing option than lengthy and publicized lawsuits.

“The brewing industry is the least likely to need us because they’re a collaborative bunch; they like to talk. But when the need arises, they are the most likely to call us,” says Gladfelter.
